Texas No Fault Divorce - Does anyone understand it?
§6.001. INSUPPORTABILITY -This is not "irreconcilable differences".
How does the law protect the family against divorce?
Does the respondent/father have rights? What are they. Where do the children stand in the suit for divorce? What you don't know will be fatal to your defense. This is why you cannot challenge a divorce.., because you don't know and there is nobody willing to tell you. Just look at the text of the statute and tell me if you or anyone else can explain what it means.
§6.001. INSUPPORTABILITY. On the petition of either party to a marriage, the court may grant a divorce without regard to fault if the marriage has become insupportable because of discord or conflict of personalities that destroys the legitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation.
By operation of law, both parties, the plaintiff & the respondant must know what this statute means.
By law, the plaintiff must prove the alegations with evidence that:
1. The legitimate ends of the marital relationship had been destroyed by;
2. Discord or conflict of personalities and,
3. This discord prevents a reasonable expectation for reconciliation.
If the plaintiff cannot give evidence that proves one or more of these 3 elements, then the burden of proof has not been met.
If the 1st point is not proven, then there is no possibility to establish the other 2 points. This is called a "no finding of facts" and the plaintiff cannot prevail on the claim. There is no way around this.
How can the plaintiff prove that the legitimate ends had been destroyed when he/she does not know what those legitimate ends are? How can the plaintiff know what this even means. Strange language? Very strange because there is nowhere to go to find the meaning behind it.., nowhere!
